DISTANCE SELLING AGREEMENT

These terms and conditions govern every order placed on tmg-tcg.com. By confirming your order you acknowledge that you have read and accepted them. They apply to consumers within the meaning of the French Consumer Code.
Article 1 — Purpose and seller
These terms govern the distance selling of sealed trading card game products (boosters, displays, boxes, decks) offered on the site. The seller is:

Article 2 — Products
The products offered are new, genuine and sealed by their publisher. They are described as accurately as possible. Product photographs are not contractual: packaging artwork may vary between publisher reprints.
Buyers should note that the contents of sealed random-content products (boosters, displays) are determined by the publisher. We guarantee neither the presence of any particular card, nor any rarity level, nor any resale value.
Only products actually held in stock are displayed on the site. An unavailable product does not appear and therefore cannot be ordered.
Article 3 — Prices
Prices are shown in euros, per item, excluding delivery costs. Delivery costs are calculated and displayed before your order is finally confirmed.

The applicable price is the one displayed on the site when the order is confirmed. We may change our prices at any time, without this affecting orders already confirmed.
Article 4 — Orders
A customer account is required in order to place an order. The ordering process runs as follows: select items and add them to the basket, review the basket, choose the address and delivery method, review the detailed summary, then pay.
Before paying, you are shown a summary allowing you to check the details of your order and its total price, and to correct any errors. Confirming payment constitutes acceptance of the order and forms the contract of sale. A confirmation email is then sent to you.
We reserve the right to refuse or cancel any abnormal order, in particular where quantities are plainly intended for resale, where there is a previous payment dispute, or where fraud is suspected. In such cases the order is refunded in full.
Under article L213-1 of the French Consumer Code, orders of €120 or more are archived for ten years and made available to you on request.
Article 5 — Payment
Payment is made online by bank card at the time of ordering. It is processed by our provider Stripe within its own secure environment.
At no point do your card details pass through our servers or get stored by us. We keep only a transaction reference.
An order is only prepared and dispatched once payment has been effectively confirmed by our provider.
Article 6 — Delivery
We deliver to France métropolitaine, exclusively via Mondial Relay.
The delivery method — pickup point or home — is chosen by you when you place the order. For pickup point delivery, you select the point yourself from the Mondial Relay network during payment; the chosen point is repeated in the confirmation email sent to you.

Orders are prepared and handed to the carrier within 2 working days of payment confirmation. Mondial Relay transit then usually takes 3 to 5 working days. These times are indicative and are not a firm commitment by the carrier.
The parcel is held for you at the pickup point for the holding period applied by Mondial Relay, stated in the arrival notice. After that period the parcel is automatically returned to us: we then contact you to arrange either a re-dispatch, at your expense, or a refund of the items.
Under article L216-6 of the French Consumer Code, if the product is not delivered within thirty days of the order, you may instruct us in writing to deliver within a further reasonable period and, failing that, terminate the contract. Sums paid are then refunded to you within fourteen days of termination.
We bear the risk of loss or damage to the parcel until it is handed over to you. If a parcel is visibly damaged we recommend recording reservations with the carrier and informing us promptly so that we can act: such reservations make handling easier but are not a condition of your right to redress.
Article 7 — Right of withdrawal
You have 14 days from receipt of your order to exercise your right of withdrawal, without giving any reason and without incurring any penalty.
To exercise it, inform us of your decision by an unambiguous statement, by email to contact@tmg-tcg.com or by post to our address. You may use the model form reproduced below, though you are not obliged to.
You must return the product without undue delay and at the latest 14 days after notifying us of your decision. Return postage is at your expense.
We will refund all sums paid, including standard delivery costs, at the latest 14 days after being informed of your decision. We may withhold the refund until we have received the product back or until you have supplied proof of dispatch. If you chose a more expensive delivery method than the standard option, only the standard amount is refunded.
Sealed products: a specific point
Our products are sold sealed by their publisher. This point deserves a precise explanation, as it is often badly worded in this sector.
The fact that a trading card product is sealed does not fall within any of the exceptions to the right of withdrawal listed in article L221-28 of the French Consumer Code. We therefore do not exclude your right of withdrawal on these products: it remains open to you in all cases.
However, article L221-23 of the same code provides that you are liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and proper functioning. Opening a sealed random-content package goes beyond such a check and causes immediate, substantial depreciation, since the contents can no longer be guaranteed. Accordingly:
- a product returned intact and still sealed by the publisher is refunded in full;
- a product returned unsealed, opened, incomplete or damaged is subject to a deduction for depreciation, which may amount to its full price.

Complete and return this form only if you wish to withdraw from the contract.

Article 8 — Legal guarantees
Independently of any commercial guarantee, we remain liable for lack of conformity and for hidden defects, under the conditions provided by law.
Legal guarantee of conformity and guarantee against hidden defects
- The consumer has a period of two years from delivery of the goods to obtain the benefit of the legal guarantee of conformity should a lack of conformity appear. During that period the consumer need only establish the existence of the lack of conformity, not the date on which it appeared.
- The consumer may choose between repair and replacement of the goods, subject to the cost conditions set out in article L217-12 of the French Consumer Code.
- The consumer is exempt from proving the existence of the lack of conformity during the twenty-four months following delivery of the goods.
- The legal guarantee of conformity applies independently of any commercial guarantee that may be granted.
- The consumer may decide to invoke the guarantee against hidden defects within the meaning of article 1641 of the French Civil Code. In that case the consumer may choose between rescission of the sale and a reduction of the price, in accordance with article 1644 of the Civil Code.
To invoke either guarantee, write to us at contact@tmg-tcg.com describing the defect found. Return postage for a non-conforming product is at our expense.
Please note that these guarantees cover the conformity of the product as marketed by the publisher (intact packaging, complete and genuine product). They do not cover the random nature of the contents of random-content products, which is inherent in their very definition.
Article 9 — Complaints
Any complaint may be sent to us at contact@tmg-tcg.com. We undertake to acknowledge receipt and to reply as quickly as possible.
Article 10 — Personal data
The processing of your personal data is described in detail in our privacy policy, which forms an integral part of these terms.
Article 11 — Intellectual property
The elements of this site (structure, texts, design) are protected and may not be reproduced without permission. Game publishers' trademarks and artwork remain the property of their respective owners and are used solely to identify the genuine products we resell.
Article 12 — Governing law and disputes
These terms are governed by French law. In the event of a dispute, an amicable solution will be sought as a priority. Failing that, the French courts will have jurisdiction, it being specified that a consumer may bring proceedings either where they reside or where the seller is established.
No provision of these terms may deprive a consumer of the mandatory rights granted to them by French law.
